1. Acceptance of Terms

- Automated Access: Using any robot, spider, scraper, crawler, or other automated means to access the Site for any purpose without our express written permission.
- Circumvention: Attempting to circumvent, disable, or otherwise interfere with any security-related features of the Site, including features that prevent or restrict use or copying of any content.
- Harassment and Abuse: Harassing, threatening, intimidating, or abusing any person through the use of the Site or our communication channels.
- Prohibited Content: Posting, transmitting, or otherwise making available any content that is unlawful, harmful, defamatory, obscene, invasive of another's privacy, or otherwise objectionable.

- Violation of Laws: Using the Site in any manner that violates any applicable federal, state, local, or international law or regulation, including, without limitation, the Computer Fraud and Abuse Act (CFAA), the Electronic Communications Privacy Act, and applicable consumer protection statutes.
We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates these provisions. This may include reporting suspected unlawful activity to law enforcement authorities, suspending or terminating your account, and pursuing civil or criminal legal remedies.
4. Account Registration and Security

The Pequod's Pizza name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Pequod's Pizza or its affiliates. You may not use such marks without the prior written permission of Pequod's Pizza. All other names, logos, product and service names, designs, and slogans on this Site are the trademarks of their respective owners.
5.2 Limited License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Site solely for your personal, non-commercial purposes. This license does not include any right to:
- Modify or copy the materials on the Site;
- Use the materials for any commercial purpose or for any public display (commercial or non-commercial);
- Attempt to decompile or reverse engineer any software contained on the Site;
- Remove any copyright or other proprietary notations from the materials; or

This license shall automatically terminate if you violate any of these restrictions and may be terminated by us at any time. Upon termination, you must destroy any downloaded materials in your possession, whether in electronic or printed format.
5.3 User-Generated Content
If you submit, upload, post, or transmit any reviews, comments, suggestions, feedback, photographs, or other content to us through the Site or any associated social media channels ("User Content"), you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media. You represent and warrant that you own or otherwise control all rights to the User Content you submit and that such content does not violate these Terms or any applicable law.
6. Payment Terms
6.1 Pricing and Fees
All prices displayed on the Site are in United States Dollars (USD) and are subject to change without notice. Applicable taxes, delivery fees (where applicable), and any other applicable charges will be calculated and displayed at checkout prior to the final confirmation of your order. You agree to pay all charges associated with your order at the prices then in effect.
6.2 Payment Methods
We accept major credit cards, debit cards, and other payment methods as indicated on the Site at the time of checkout. By submitting payment information, you represent and warrant that you are authorized to use the designated payment method and authorize us to charge your payment method for the total amount of your order, including all applicable taxes and fees.
6.3 Order Confirmation and Accuracy

We are not responsible for errors in orders that are not reported to us in a timely manner. By ordering from us, you acknowledge that you have been informed of this risk and agree to hold us harmless from any claims arising from allergen-related incidents, subject to applicable law.
8. Disclaimer of Warranties
THE SITE AND ALL CONTENT, SERVICES, PRODUCTS, AND OTHER MATERIALS AVAILABLE THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW.
PEQUOD'S PIZZA EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
- WARRANTIES THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;
- WARRANTIES REGARDING THE ACCURACY, RELIABILITY, TIMELINESS, OR COMPLETENESS OF ANY CONTENT OR INFORMATION AVAILABLE ON THE SITE;
- WARRANTIES THAT DEFECTS IN THE SITE WILL BE CORRECTED; AND
- WARRANTIES REGARDING THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SITE OR ANY SERVICES.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. In such jurisdictions, our liability shall be limited to the greatest extent permitted by applicable law.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE FEDERAL AND STATE LAW, IN NO EVENT SHALL PEQUOD'S PIZZA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, SERVICE PROVIDERS, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES;
- LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITIES, OR ANTICIPATED SAVINGS;
- DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA;
- DAMAGES ARISING FROM ANY CONTENT OR CONDUCT OF ANY THIRD PARTY ON THE SITE; OR
- DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE OR ANY SERVICES.
THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION WILL BE LIMITED TO THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).
Some states do not allow limitations on implied warranties or exclusions of certain types of damages, so some of the above limitations may not apply to you. These Terms give you specific legal rights, and you may also have other rights which vary by state.
10. Indemnification
You agree to defend, indemnify, and hold harmless Pequod's Pizza, its affiliates, officers, directors, employees, agents, licensors, service providers, and their respective successors and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including, but not limited to, attorneys' fees and court costs) arising from or relating to:
- Your use of or access to the Site or services;
- Your violation of any term of these Terms of Service;
- Your violation of any third-party right, including without limitation any copyright, property, privacy, or other rights;
- Any User Content you submit, post, transmit, or otherwise make available through the Site;
- Your violation of any applicable federal, state, or local law, regulation, or ordinance; or
- Any claim that your User Content caused damage to a third party.
This indemnification obligation will survive the termination of these Terms and your use of the Site. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such event, you agree to cooperate with our defense of such claim.
11. Third-Party Links and Services
The Site may contain links to third-party websites, applications, or services ("Third-Party Services") that are not owned or controlled by Pequod's Pizza. These links are provided solely as a convenience to you. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
We do not warrant the offerings of any of these third parties or their websites. You acknowledge and agree that Pequod's Pizza shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such third-party websites or services.
We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit or use, including any third-party delivery platforms, payment processors, or review sites with which we may partner.
12. Privacy Policy

13. Governing Law and Jurisdiction
These Terms of Service and any dispute or claim arising out of or relating to them, their subject matter, or their formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the United States of America and the applicable laws of the state in which Pequod's Pizza is registered and operates, without regard to any conflict of law provisions.
You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the federal or state courts of competent jurisdiction located in the United States. You hereby consent to the personal jurisdiction and venue of such courts and waive any objection to the laying of venue of any such proceeding in such courts.
Notwithstanding the foregoing, we reserve the right to seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property rights or to prevent irreparable harm.
14. Dispute Resolution
14.1 Informal Resolution
Before initiating any formal legal proceeding, you agree to first contact us and attempt to resolve any dispute informally. Please send a written description of your dispute to [email protected]. We will attempt to resolve the dispute informally within thirty (30) days of receiving your notice. If the dispute is not resolved within that period, either party may pursue formal dispute resolution as described below.
14.2 Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. Except for disputes that qualify for small claims court, and except for actions seeking injunctive or other equitable relief for the alleged unlawful use of intellectual property, you and Pequod's Pizza agree that any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or validity thereof, or your use of the Site or services, shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules, rather than in court.
The arbitration shall be conducted in the English language. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. The Federal Arbitration Act (FAA), 9 U.S.C. § 1 et seq., governs the interpretation and enforcement of this arbitration provision.
14.3 Class Action Waiver
YOU AND PEQUOD'S PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Pequod's Pizza agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
14.4 Exceptions to Arbitration
Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes or claims within the scope of that court's jurisdiction. Either party may also seek emergency injunctive relief from a court of competent jurisdiction to prevent imminent irreparable harm pending arbitration.
15. Term and Termination
These Terms shall remain in full force and effect while you use the Site or any of our services. We may, in our sole discretion and without prior notice or liability, deny access to and use of the Site to any person for any reason or for no reason at all, including without limitation for breach of any representation, warranty, or covenant contained in these Terms or of any applicable law or regulation.
You may terminate your account at any time by contacting us at [email protected] and requesting account deletion. Upon termination of your account, your right to use the Site will immediately cease.
All provisions of these Terms which by their nature should survive termination shall survive, including without limitation, ownership provisions, warranty disclaimers, indemnity provisions, and limitations of liability. Termination of your account does not relieve you of any obligations to pay fees or charges that may have accrued prior to such termination.
16. Changes to Terms of Service
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page. 17. Severability

The invalidity or unenforceability of any provision of these Terms shall not affect the validity or enforceability of any other provision. These Terms shall be construed as if the invalid or unenforceable provision had been modified or severed from the beginning, and all remaining provisions shall be given their fullest effect under applicable law.
18. Entire Agreement
These Terms of Service, together with our Privacy Policy and any other legal notices or agreements published by us on the Site, constitute the entire agreement between you and Pequod's Pizza with respect to the subject matter hereof and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter.
No waiver by Pequod's Pizza of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Pequod's Pizza to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
19. No Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Site and supersede and replace any prior agreements we might have between us regarding the Site.
20. Force Majeure
Pequod's Pizza shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, epidemics or pandemics, acts of war or terrorism, civil unrest, governmental actions, labor disputes, supply chain disruptions, power outages, internet or telecommunications failures, or any other event beyond our reasonable control ("Force Majeure Event").
In the event of a Force Majeure Event, we will provide notice as soon as reasonably practicable and will use commercially reasonable efforts to resume performance as soon as possible. Our obligations under these Terms shall be suspended for the duration of the Force Majeure Event to the extent affected thereby.
21. Electronic Communications
By using the Site and providing your email address, you consent to receive electronic communications from Pequod's Pizza, including order confirmations, updates, promotional materials, and other notices. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing, to the extent permitted by applicable law.
If you wish to opt out of receiving promotional communications, you may do so by following the unsubscribe instructions included in such communications or by contacting us directly. Please note that even if you opt out of promotional emails, we may still send you transactional or administrative communications related to your account or orders.
22. Compliance with Laws
